What was requested
An existing list, log, register or index of data center nondisclosure or confidentiality agreements involving current or former supervisors and Planning Commission members, with existing information on officials, companies, dates and status. The original request did not ask the County to create a new list.
What Stafford sent back
The County said the requested list, log, register or index could not be found or does not exist. It instead produced what it described as the two nondisclosure agreements Stafford County has with any data center: Amazon and STACK. The closure notice is dated October 16, 2026. In a correction sent at 2:07 p.m. that day, the County said the earlier cost estimate had been assigned to the wrong request and that request #5250 had no charge. The withdrawn estimate files are retained with clear labels in the response archive.
What this response establishes
This response does not establish that individual supervisors or commissioners signed an NDA. The Amazon document is signed for the County by Thomas C. Foley on February 19, 2020. The STACK document is signed for the County by William H. Ashton, II on March 10, 2025. Both documents include provisions addressing legally required disclosure; an NDA alone does not establish wrongdoing.
